Attorneys obtained a summary judgment dismissal of a declaratory judgment action against a large insurance company brought by another insurance carrier. The action arose as a result of a fatal automobile accident in which three insurance policies were at issue, two of which, including our client's, potentially providing excess coverage and containing competing other insurance clauses and provisions. We were able to successfully argue that the large insurance company's personal liability protection policy is essentially an ultimate excess policy and not a contributing excess policy pursuant to the language of the applicable policies and the law. Summary Judgment was granted and the declaratory action against our client was dismissed with prejudice.
