Attorneys obtained summary judgment on behalf of an insurance company. The insurance company provided general liability coverage for a company that sold materials utilized in construction. It was alleged that employees of the insured were negligent in managing the construction site and directing traffic during the movement of a construction vehicle. A vehicle collided with the construction vehicle resulting in a suit against the insured even though the construction vehicle was not owned or operated by the insured. The insurance compnay disclaimed coverage based upon the motor vehicle exclusion in the CGL policy. The insured argued that claims alleging negligent supervision of a construction site did not fall within the motor vehicle exclusion. The court agreed with our argument that the motor vehicle exclusion were extremely broad, and concluded that the insured was not entitled to a defense or indemnification.
