Attorneys’ obtained Declaratory Judgment against an alleged insured seeking benefits under a policy of insurance issued by our client in connection with an alleged motor vehicle accident

Attorneys’ obtained Declaratory Judgment against an alleged insured seeking benefits under a policy of insurance issued by our client in connection with an alleged motor vehicle accident.  The claimant was not a named insured under the policy but rather, was an alleged passenger in a vehicle of a named insured at the time of the accident.  Repeated requests for the claimant's cooperation were disregarded by the claimant.  Despite being represented by legal counsel, who filed a responsive pleading to our Verified Complaint, the Court ruled in our favor and voided the claim by the alleged claimant against our client pursuant to the terms and conditions of the policy under which benefits were being sought including but not limited to the cooperation clauses contained therein.
