Attorney prevailed on behalf of defendant insurance company in a Personal Injury Protection (PIP) arbitration conducted under the auspices of the National Arbitration Forum. The claimant was a chiropractor who had extensively treated an insured, following an alleged accident in a parking lot in which the insured's vehicle had been bumped by another, unknown vehicle. The insured had failed to disclose to the chiropractor a number of other vehicular accidents. The insured's attorney failed to produce his client for a statement. The arbitrator found that a valid basis existed for investigating the insured, and his non-cooperation constituted a material breach of the insurance contract. That breach resulted in the forfeiture of any claim for benefits for the insured and his assignee, the chiropractor.
