Attorney obtained a favorable decision in the National Arbitration Forum. Following a binding arbitration hearing, the arbitrator found in favor of defendant insurance company with regard to the medical providers' Demand for Arbitration seeking reimbursement of Personal Injury Protection Benefits because the medical provider failed to prove by a preponderance of the evidence that the injuries for which treatment was rendered were proximately caused by the June 23, 2003 automobile accident. The insured was involved in subsequent motor vehicle accidents on August 30, 2004 and February 14, 2005, involving substantial injuries which were never addressed by the treating medical provider. Thus, the Arbitrator held that the medical provider was not entitled to reimbursement.
