Attorney obtained dismissal with prejudice of a counterclaim filed against defendant insurance company in state court. The counterclaim alleged: Bad Faith Denial of Insurance claims; Estoppel; Unjust Enrichment; Breach of Duty of Good Faith and Fair Dealing and Tortious Interference. Defense attorney successfully argued these claims must be dismissed because the only available remedy in a dispute over PIP benefits, is the remedy contained in the PIP statute.
