Attorney obtained dismissal of a complaint filed against our client, an insurance agency. After plaintiffs' building was damaged in a fire, plaintiffs filed a bad faith claim against their insurance company. The insurance company joined our client as an additional defendant and immediately filed a petition to dismiss plaintiffs' claims for forum non conveniens. The court granted the insurance company's motion, dismissing plaintiffs' claims with leave to re-file in another state. Plaintiffs appealed, and the Superior Court eventually affirmed the trial court's ruling. Plaintiffs thereafter filed suit against both the insurance company and our client in the other state. We filed a motion to dismiss, arguing that plaintiffs' claims were time-barred. Plaintiffs argued that the statute of limitations governing their claims was tolled during the pendency of the previous action. The Circuit Court agreed that the tolling doctrine was inapplicable and dismissed plaintiffs' claims with prejudice.
