Attorney obtained a defense award in National Arbitration Forum. Claimant was seeking reimbursement of medical expenses for chiropractic treatment as well as attorney fees and costs. Despite 47 treatments over a period of five months with a prior chiropractor, the patient continued to complain of persistent neck pain, hand numbness, severe mid back pain, persistent low back pain, and severe left leg pain. She then proceeded to undergo additional chiropractic treatment with another chiropractor for another five months undergoing the same treatment and same results. The DRP found that the claimant had not met her burden of proof that the additional chiropractic treatment was medically necessary or reasonable in accordance with the statute. He also found the medical treatment exceeded the Care Paths as regulated by the statute The DRP denied the claim in full including attorney fees and costs.
