Attorney obtained Declaratory Judgment on behalf of our client insurance carrier against an alleged insured

Attorney obtained Declaratory Judgment on behalf of our client insurance carrier against an alleged insured in connection with a claim submitted relating to a motor vehicle accident and for which medical providers had submitted claims for Personal Injury Protection benefits.  Following the alleged insured's repeated failure to cooperate under the terms of the policy as well as investigation into the impossibility of the insured's involvement in the accident as alleged, application was made to void the claim by the alleged insured for the accident under our client's policy.  Following extensive briefing and oral argument, the court granted the relief sought and declared the claim void.
