Leone v. North Jersey Orthopedic Specialists, Docket No. 11-3957 (U.S.D.C., April 27, 2012)

ADA requirement of establishing substantial limitation on major life activity.

The plaintiff alleged that she was terminated because she needed to leave work to undergo treatment for a Protein S. deficiency. The plaintiff's complaint alleged that, with this accommodation she was fully capable of performing her job functions. In dismissing the ADA claim, the court held that, while the plaintiff's medical condition constituted a "disability" under the statute, she could not state a claim since the disability did not substantially limit a major life activity.
