We prevailed in defending a defamation claim brought by a builder/developer against an attorney arising out of an underlying Chancery Division action. We obtained summary judgment and dismissal of the defamation claim in the trial court and obtained affirmation on appeal. The opinion of the Appellate Division is significant because the attorney spoke to the press after the hearing in the underlying case. Rather than simply saying, "No comment," or simply stating exactly what the court ruled in his favor against the builder/developer, the attorney used hperbole and embellished the findings of the court. Also, our clients were awarded counsel fees as a sanction under New Jersey's Frivolous Litigation Statute, which was also affirmed by the Appellate Division.
