Attorneys obtained summary judgment in a legal malpractice matter. Plaintiff was allegedly injured while boarding a Transit train. He retained our client to represent him. Our client filed a notice with the Transit Provider of the tort claim. Subsequently, our client declined to handle the case further. Plaintiff retained other counsel who filed a motion for permission to file a late tort claim notice. The motion was denied . The correspondence and notice of claim sent by our client to the Transit Provider was not produced in reference to the motion filed and was denied. The Transit Provider file subpoeaned in the legal malpractice case showed that they received the notice of claim from our client. The judge granted summary judgment, ruling that our client's notification of the plaintiff's claim was timely, and in compliance with the requirements of the Tort Claims Act.
