Attorney successfully obtained affirmance of a unanimous defense verdict that she secured on behalf of a contract security company in a negligent security/medical malpractice wrongful death case. The Appellate Division agreed that the trial court's refusal to charge the jury that plaintiffs' decedent's conduct could not be considered for any purpose was proper where the trial court used the Model Jury Charge and instructed the jury that the decedent's conduct was to be ignored. The Appellate Division also agreed that plaintiffs were not entitled to a charge that the defendants (including the psychiatrist, hospital and nurses) owed the decedent, a psychiatric patient, a special duty of care to prevent him from committing suicide. The Appellate Division also rejected plaintiffs' challenge to various evidentiary rulings, agreeing that there was no palpable abuse of discretion.
