Successfully defended tour operator when woman's excursion to Egyptian "family cave" results in injury.

Obtained summary judgment in a case involving a woman who booked a trip to Egypt through a travel agency with the client, an international tour operator. During an optional excursion to an Egyptian tour guide's family cave, the woman was injured and brought a lawsuit against the client on theories of negligent operation, control and supervision, failure to exercise reasonable care and to warn. The defense obtained summary judgment and the first published state court decision in New Jersey that addressed (1) the enforceability of a travel agent's written disclaimer of liability and (2) whether or not expert evidence is necessary to prove that an independent tour operator failed to exercise due diligence in its selection of an independent operator of foreign travel services.
