Significant Representative Matters

  • Ross v. Lowitz, 222 N.J. 494 (2015): In this environmental and toxic tort action, Kevin represented the prior owner of a property where an underground storage tank had leaked and contaminated the soil and groundwater of two adjacent properties, including the plaintiffs’.  In this video, Kevin successfully argued that the plaintiffs' claims for nuisance and trespass should be dismissed because there was no evidence that the underlying intrusion was intentional, or that defendant's actions were negligent, at a minimum.  https://www.youtube.com/watch?v=uuXNlJaHBrs.
