The plaintiff alleged that our client, along with several township officials and Commission employees, conspired against him to violate his First Amendment right to run for political office. The court concluded that the plaintiff failed to produce any evidence that our client conspired with the state actor defendants to deprive him of his First Amendment rights. The court also found that, even if our client had created and directed distribution of the campaign flier on election day, his conduct in doing so itself was a protected activity under the First Amendment, particularly since the plaintiff acknowledged the contents of the flier were true.
