Attorneys obtained summary judgment in favor of defendant insurance company in an insurance coverage declaratory judgment action. Defendant's insured was sued in state court by a mining company asserting property damage against the insured arising from the design and/or construction of certain mining equipment and a mining tunnel by the insured. Defendant issued a CGL and Umbrella policy to the insured. The court agreed with the defendant that the allegations constituted claims of faulty workmanship, which cannot be an "occurrence" under the policies. The court also held that the damage to the property manifested before the defendant's policy period. The court also agreed with defendant that placement of the tunnel and appropriate planning for settlement of the land were part of the product and not a service. The court declared that defendant did not owe the insured a duty to defend or a duty to indemnify.
