Attorneys obtained summary judgment dismissal of a Complaint by a former student, through his parents, against a Board of Education, claiming civil rights violations, Tort Claims Act violations, and intentional infliction of emotional distress. The claims arose as a result of the student not being selected for the high school basketball team. Plaintiff claimed he was retaliated against because of his mother's exercise of her free speech rights when she complained previously about the sports program at the school and thus, Plaintiff's equal protection and substantive due process rights were violated. The Court granted Defendant's Motion for Summary Judgment and dismissed the action.
