Attorneys obtained summary judgment on behalf of a Township.  Plaintiff owns a dental practice on property that contains a large underground drainage pipe that runs between two concrete culverts owned by PennDOT.  The Plaintiff alleged that the Township in addition to PennDOT and the prior property owners who constructed and installed the drainage pipe should be held liable as a result of various failures in the pipe that caused sinkholes to form on the property.  Plaintiff further claimed that the drainage pipe was part of a storm water management system of the Township.  However, the Court accepted the argument that the drainage pipe conveyed a naturally flowing stream of which the Township did not own, did not adopt as part of any storm water management system, and of which the Township was not responsible to maintain despite the fact that the stream collected storm water runoff from the Township
