Attorneys obtained summary judgment and dismissal of defendants, two subcontractors who performed sheet rock work at a portion of the construction of a casino, in a claim brought by an injured construction employee of the general contractor. Plaintiff suffered a permanent, disabling knee injury as a result of a fall at the construction site, and he claimed that the defendantss were liable for his fall on debris that remained at the job site on a non-normal work day, notwithstanding provisions in the construction agreements concerning clean up and removal of debris. The court granted defendants' Motion for Summary Judgment and dismissed the two defendant subcontractors, finding the evidence was not sufficient to establish wrong doing on their part.
