Attorneys obtained a dismissal with prejudice of plaintiff's complaint in a legal malpractice claim. The plaintiff was a lawyer who entered into a business deal to buy property in order to open a brothel and swinger's club. The seller reneged on the deal and the lawyer hired a hit man to murder the seller. Defendant was the criminal defense lawyer appointed to represent the plaintiff at a Post-Conviction Relief Act hearing. Plaintiff alleged that defendant made defamatory remarks about the plaintiff to the press and to the Court at the hearing and in a subsequent letter requested by the judge. The court in this case sustained defendant's preliminary objections and dismissed the complaint on the ground that the defendant's oral and written communications with the Court were entitled to absolute privilege.
