Attorneys obtained a defense verdict in a premises liability / products case. Plaintiff alleged that our client, a large retail chain, failed to properly maintain the automatic entry doors causing them to violently strike her. She also alleged that our client outrageously refused to render medical assistance and call for an ambulance. The defense was able to undermine plaintiff's liability expert by confronting him with prior inconsistent expert reports and deposition. Plaintiff's medical expert opined that the store's refusal to call an ambulance lead to a significant delay in treatment which exacerbated plaintiff's injuries. Using screen captures from the store surveillance video and the emergency room records, we were able to prove that there was not any delay in treatment. In fact, store employees responded within seconds, plaintiff was put in transport within ten minutes of her fall, and she was admitted to the hospital within 15 minutes of her fall. After the completion of plaintiff's case, the judge granted our motion for directed verdict on plaintiff's punitive damages claim.
