Attorneys obtained a defense verdict on behalf of their client, a general surgeon. Plaintiff had claimed that the surgeon, along with anesthesia defendants, had negligently failed to place a nasogastric tube in the patient before a procedure for a partial bowel obstruction, which allegedly led to her aspiration during induction of anesthesia, and to related complications including her death. The attorney successfully proved that the care was not negligent, and in fact, the placement of such tube in a patient who previously had undergone a gastric bypass procedure, was contraindicated. The jury returned a defense verdict, finding no negligence on the part of the surgeon.
