Attorneys obtained a defense verdict on behalf of their client, an eye surgeon. Plaintiff, a mono-ocular 78 year old man claimed that the ophthalmologist negligently performed cataract surgery and negligently failed to warn him of the potential risks and complications of the procedure. Plaintiff had a difficult post operative course due to retained nuclear fragments and ultimately underwent a corneal transplant by another eye specialist. His vision improved to 20/40 with corrective lenses. The attorneys' successfully proved that the cataract surgery was necessary, properly performed and that the plaintiff was fully informed of the risk of complications prior to the surgery. After a seven day trial the jury returned a defense verdict, finding no negligence on the part of the ophthalmologist.
