Attorney secured a Rule 50 Motion for Judgment as a Matter of Law. The court found that the plaintiff's claim for hostile work environment based on race could not go to the jury where plaintiff had insufficient evidence that her suspension for excessive use of the telephone, her requirement for reporting her whereabouts and her supervisor's denial of flex time were based on race. The Court also dismissed the plaintiff's constructive discharge claim. There was no appeal.
