Attorney prevailed on summary judgment on behalf of a School District and several of its administrators. Plaintiff, a former Assistant Superintendent of the School District, brought suit under 42 U.S.C. 1981 and 1983 alleging she was subjected to discriminatory treatment because of her race, which she claimed adversely affected the terms and conditions of her employment. The Complaint further alleged First Amendment Retaliation and State Civil Conspiracy claims against the District. The Court held that the Plaintiff failed to make out a prima facie case of discrimination by failing to identify any actionable adverse employment action that was taken against her during her employment, and by failing to point to any evidence illustrating that her race played any part in the decisions made by the District. Similarly, the Court held that the Plaintiff failed to establish facts that would support her First Amendment Retaliation and/or State Civil Conspiracy claims. As a result of these findings, the judge entered an Order granting the District's Motion for Summary Judgment and dismissing Plaintiff's Complaint in its entirety.
