Attorney prevailed on summary judgment on behalf ofa city Parking Authority and several of its present and former officers in a civil rights action. Plaintiff was employed by the Authority as a ticket cashier, and she was terminated from her employment after the Authority concluded that she had been stealing money from her ticket booth. Plaintiff alleged that she was subjected to retaliation in violation of her First Amendment rights, claiming she was fired not because she had stolen money but because she previously had filed a grievance against the Authority for an unrelated matter. Plaintiff further alleged her First Amendment rights were violated because the Authority failed to re-hire her after the criminal proceedings brought against her for the reported theft resulted in a not guilty verdict. Plaintiff also asserted violations of her Fourteenth Amendment due process and equal protection rights and civil rights conspiracy, and she asserted state law claims of wrongful termination and intentional infliction of emotional distress as well. The Court concluded that Plaintiff's First Amendment-termination, Fourteenth Amendment and wrongful termination claims were time barred, as she failed to file suit for more than four years following her termination, rejecting Plaintiff's "continuing violation" argument. The Court also concluded that Plaintiff failed to produce sufficient evidence that the Authority's failure to re-hire her was a violation of her First Amendment rights, and that Plaintiff failed to prove a prima facie IIED claim as a matter of law. The Court further dismissed the civil rights conspiracy claim.
