Attorney obtained two Summary Judgments on behalf of defendant insureds. Plaintiffs, in two separate cases, alleged injuries caused by the insured as a driver only. No allegation of negligent entrustment was made. The Complaint was never amended after discovery during which time Plaintiffs admitted the named defendant was not the driver. At argument, Plaintiffs' counsel argued that the language of the Complaint encompassed allegations of negligent entrustment. The Court found in favor of the Defendant on both cases that negligent entrustment was not properly alleged against the Defendant within the Statute of Limitations.
