Attorney obtained summary judgment in a prisoner civil rights action filed pursuant to 42 U.S.C. Section 1983 against a prison psychiatrist.  Plaintiff claimed that the prison psychiatrist was deliberately indifferent in failing to protect him from a violent assault by a cell mate who was allegedly known to be mentally unstable due to non-compliance with prescribed psychiatric medications and therefore manifesting bizarre and dangerous behavior.  The attorney was successful in countering this claim through supporting affidavits from prison officials and medical department personnel, short of formal discovery and extensive litigation.
