Attorney obtained summary judgment in a premises liability matter on behalf of a diner in where plaintiff claimed to have fallen and sustained serious knee injuries and an aggravation of an arthritic condition. Plaintiff admitted in depositions that she could not describe the area where she fell. The deposition revealed further inconsistencies in the plaintiff's testimony concerning prior knee injuries. Further, emergency room records showed that the plaintiff went to the emergency room on the day before the subject accident.
