Attorney obtained summary judgment in an excessive force/false arrest claim. The plaintiff, a convicted felon, was driving the wrong way on a busy highway and was arrested by our client for drug possession and DUI. He was sent back to prison for the remainder of a murder sentence. The plaintiff had argued that the search of his vehicle, incident to his arrest, was illegal. Our client, a local municipal police officer, had asked the plaintiff for the location of the car's registration and was directed to the glove box by the plaintiff, who apparently forgot that this is also where he kept his narcotics.
