Attorney obtained an Order granting Final Summary Judgment on behalf of our client, a national car rental company, based upon the Graves Amendment. The renter had permitted a unlicensed driver to use the rental car. The rental car ran a red light and impacted another vehicle, causing that vehicle to impact two motorcycles occupied by the Plaintiffs. One Plaintiff sustained a fracture to her ankle. She underwent surgery and had an open reduction and internal fixation. The second Plaintiff sustained a rotator cuff tear also requiring surgery. Neither the renter or the driver had insurance coverage and had failed to purchase the supplemental liability coverage from the rental car company. The Court's ruling capped the rental car company's liability at the financial responsibility limits and the rental car company is now moving for attorney's fees and costs pursuant to the Proposal for Settlement previously filed.
