Attorney obtained an order dismissing all counts against our client home owner in case where the plaintiff was shot in the head while on our insured's property. The court ruled, in essence, that because no special relationship existed between the home owner and the plaintiff that the homeowner owed no duty to protect the plaintiff from the criminal acts of third parties as a matter of law.
