Attorney obtained a favorable decision in the National Arbitration Forum. Following a binding arbitration hearing, the arbitrator held that although the insured failed to attend numerous Examinations Under Oath, the medical provider was still entitled to reimbursement of PIP benefits. On Appeal, the defense attorney was successful in reversing the Arbitrator's decision because the National Arbitration Forum Appellate Panel found that the Arbitrator failed to discuss the insured's duty to cooperate pursuant to the terms of the defendant's policy of insurance.
