Attorney obtained dismissal of our clients, a police Corporal and his Department, on a Motion to Dismiss. Plaintiff had claimed that the Corporal's "rough driving" following her lawful arrest for theft, amounted to negligence (under the Vehicle Code) and excessive force (under the 14th Amendment). The attorney successfully argued to the Court that negligence cannot form the basis of a civil rights claim, that the 14th Amendment was an improper basis for an excessive force claim and that the Vehicle Code does not provide basis for a civil suit under state law.
