Attorney obtained the dismissal of all claims brought by plaintiff against a demolition subcontractor. Defendant owned a demolition company that was assisting in renovating a building, and plaintiff alleged that he was injured on his first day of work when a brick wall collapsed on him. Defendant drove plaintiff to a hospital on that day and then did not hear from plaintiff again. Plaintiff added defendant to his claim for this injury after the statute of limitations had expired, and subsequently filed a Complaint in which he alleged that defendant did not have workers' compensation insurance. Defendant did have workers' compensation insurance, but the plaintiff had never placed defendant on notice of a claim. The Court dismissed all claims against defendant with prejudice because plaintiff's claim was precluded by the Workers' Compensation Act and plaintiff named defendant as a defendant after the statute of limitations had expired.
