Attorney obtained a defense verdict in a premises liability case in which he successfully defended a nail salon. The plaintiff was a 67-year old woman who had just received a pedicure. She was instructed to walk from the pedicure chair to the manicure chair. In attempting to sit in the manicure chair, she claimed that the chair, which was on wheels, rolled out from under her causing her to fall. The plaintiff suffered three herniated disks and underwent a three level cervical fusion. Plaintiff alleged that the nail salon was negligent for using chairs on wheels on a tile floor and negligent for not properly assisting customers into the chair. The defense argument was the plaintiff simply missed the chair when attempting to sit down. The jury was out 28 minutes before coming back with a verdict of no negligence.
