Attorney obtained a defense verdict in an automobile negligence matter. Plaintiff alleged bulging discs, right wrist sprain, bilateral shoulder strain/sprain, cervical and dorsal strain/sprain. Liability was stipulated, and at issue was only whether the plaintiff's injuries were caused by the accident and if they were permanent in nature. Plaintiff testified that she was in daily pain, could no longer walk or grocery shop without taking a break, and that she could no longer play with her grandchildren in the park. On cross examination, plaintiff admitted that she had two prior work related injuries to her back and shoulder. The jury deliberated for under two hours and came back with a unanimous 7-0 verdict that plaintiff's injuries were not caused by the subject motor vehicle accident.
